TERMS AND CONDITIONS OF SALE
PREAMBLE
The website www.agape-paper.com (hereinafter referred to as “the Site”) is published and operated by The Smart Ritual SRL, whose registered office is located at 13 avenue Albert, 1190 Forest, Belgium, registered with the Belgian Crossroads Bank for Enterprises under number 1014.550.912, and whose VAT number is BE 1014.550.912.
These Terms and Conditions of Sale (hereinafter referred to as “T&Cs”) are concluded between:
The company The Smart Ritual SRL, operator of the website www.agape-paper.com (hereinafter referred to as “the Site”), whose purpose is the sale of stationery products, including coaching and therapeutic journals, planners, notebooks, writing materials, office supplies, and other related items, available in both physical and/or digital formats.
Any natural or legal person wishing to make a purchase via the Site (hereinafter referred to as “the Customer”).
Placing an order on the Site implies full and unconditional acceptance of these T&Cs.
1. PURPOSE
These T&Cs define the contractual relationship between The Smart Ritual and the Customer in the context of online sales of products offered on the Site, in both physical and/or digital formats.
2. PRODUCTS
The products offered for sale are those listed on the Site, subject to availability for physical items. Certain items, such as planners and coaching or therapeutic journals, may be offered in both physical and/or digital formats, as specified at the time of ordering. Product images are for illustrative purposes only and are not legally binding. The Smart Ritual strives to provide accurate product descriptions; however, errors or omissions may occasionally occur.
3. PRICES
Prices are indicated in euros (€), inclusive of all taxes (VAT included), and exclude delivery charges for physical products. The Smart Ritual reserves the right to modify its prices at any time, but products will be billed at the rate in effect at the time the Customer confirms the order.
4. ORDERING
The Customer may place an order directly through the Site. Any order placed constitutes acceptance of the prices and product descriptions. The Smart Ritual will confirm each order by email, sent to the address provided by the Customer at checkout.
5. PAYMENT
Payment is due immediately upon placing the order. The Customer may make payment using the methods available on the Site. Transactions are secured by Wix Payments or another authorised payment service provider. The Smart Ritual reserves the right to suspend any order in the event of payment authorisation refusal.
6. DELIVERY
Physical products are shipped to the address specified by the Customer during checkout. Delivery fees and times are indicated on the Site and may vary depending on the Customer’s geographic location. The Smart Ritual cannot be held responsible for delivery delays caused by the carrier. Digital products are available for download directly from the Site or sent by email once payment has been received.
7. RIGHT OF WITHDRAWAL
7.1 Right of withdrawal for physical products
In accordance with European legislation, the Customer has a period of fourteen (14) calendar days from receipt of their order to exercise the right of withdrawal, without providing reasons or incurring penalties.
To exercise this right, the Customer must notify The Smart Ritual by email at info@agape-paper.com, indicating the order number and the products concerned. A withdrawal form is available upon request to simplify this process.
7.2 Return of physical products
The Customer must return the products at their own expense within fourteen (14) days following notification of withdrawal. Products must be in perfect condition, in their original, unopened packaging. All items must be returned sealed and unused.
Please note: stationery products such as planners, coaching or therapeutic journals, and other writing supplies cannot be returned if they have been used, marked, or written on. Only items that remain unaltered and intact may be accepted. Damaged, used, or unsealed items will not be refunded.
Return address: the return address will be communicated by The Smart Ritual in the withdrawal confirmation email.
7.3 Refund
Subject to compliance, The Smart Ritual undertakes to refund the Customer within fourteen (14) days of receiving the returned products. Refunds will be made using the same payment method used for the original transaction.
7.4 Right of withdrawal for digital products
In accordance with EU regulations, the right of withdrawal does not apply to digital products once downloaded or accessed online, where execution has begun with the Customer’s prior consent and express waiver of this right.
8. WARRANTY AND RETURN OF DEFECTIVE PRODUCTS
Products are covered by the legal guarantee of conformity and the statutory warranty against hidden defects. In the event of non-conformity or defect, the Customer may request repair, replacement, or refund, subject to verification by The Smart Ritual.
9. LIMITATION OF LIABILITY FOR COACHING AND THERAPEUTIC JOURNALS
The coaching and therapeutic journals offered by The Smart Ritual are designed to support personal development and well-being. They do not constitute medical treatment or supervised therapy and must not replace professional advice or care. The Smart Ritual does not guarantee specific results, as outcomes depend on each user’s personal engagement and circumstances. Use of these journals is entirely at the Customer’s own responsibility.
10. LIABILITY
The Smart Ritual shall not be held liable for any indirect damages resulting from the use of products sold. It shall not be responsible for events of force majeure, postal or transport strikes, or communication disruptions.
11. INTELLECTUAL PROPERTY
All elements of the Site (texts, images, logos, etc.) are protected by copyright. Any full or partial reproduction of the Site is strictly prohibited without prior written authorisation.
12. PERSONAL DATA PROTECTION
Information collected during orders is necessary for order management and may be shared with contractual partners of The Smart Ritual. In accordance with the General Data Protection Regulation (GDPR), Customers have the right to access, rectify, and delete their personal data by contacting info@agape-paper.com.
13. MODIFICATION OF THE T&Cs
The Smart Ritual reserves the right to modify these T&Cs at any time. The applicable version is that in effect on the date of the Customer’s order.
14. GOVERNING LAW AND JURISDICTION
These T&Cs are governed by Belgian law. In the event of dispute, the courts of Brussels (Belgium) shall have exclusive jurisdiction.
15. DIGITAL CONTENT PROTECTION
The Smart Ritual operates accounts on social networks, including Instagram, YouTube, and TikTok, where it shares informational and promotional content relating to its products. All such content, including but not limited to videos, photos, text, logos, and designs, is the exclusive property of The Smart Ritual and protected under intellectual property law.
16. TRADEMARKS AND INTELLECTUAL PROPERTY RIGHTS
The brand The Smart Ritual and all products marketed under this name are registered trademarks protected by applicable intellectual property law. Any unauthorised reproduction, imitation, or use of the brand or products may lead to legal proceedings.
17. LIMITATION OF LIABILITY REGARDING ADVICE AND RECOMMENDATIONS
Any advice or recommendations provided on the Site or The Smart Ritual’s social media are for informational purposes only and do not constitute contractual commitments. The Smart Ritual shall not be held liable for results or consequences arising from the implementation of such advice.
18. FORCE MAJEURE
The Smart Ritual shall not be held liable for the non-performance or delay of its contractual obligations in the event of force majeure as defined under Belgian law, including but not limited to natural disasters, fires, strikes, pandemics, or transport disruptions.
19. VALIDITY
If any clause of these T&Cs is deemed invalid or unenforceable by a competent court, such clause shall be considered null and void without affecting the validity of the remaining provisions.
20. PROMOTIONS AND DISCOUNT CODES
Promotional codes and discounts offered by The Smart Ritual are valid only under the conditions specified on the Site and may be used once per person, unless otherwise stated. Discount codes cannot be combined unless expressly indicated and do not apply to delivery fees.
21. AFTER-SALES SERVICE
For any claim, enquiry, or question regarding a purchased product, Customers may contact The Smart Ritual’s after-sales service via info@agape-paper.com. The company undertakes to respond within 14 working days and provide an appropriate solution in case of non-conformity.
22. PRE-ORDERS
Products offered for pre-order are clearly identified on the Site. Payment is required to confirm the reservation. Delivery times for pre-ordered items may vary and will be indicated during purchase. In case of significant delay, Customers will be informed and may cancel the order for a full refund.
23. PRICE AND DESCRIPTION ERRORS
Despite The Smart Ritual’s best efforts to ensure accuracy, certain descriptions or prices may contain errors. In such cases, the Customer will be informed promptly and given the option to confirm or cancel the order for a full refund.
24. ENVIRONMENTAL COMMITMENT
As part of its environmental responsibility, The Smart Ritual strives to offer products made from sustainable materials and packaged in recyclable materials. Customers are encouraged to recycle packaging appropriately.
25. NON-RESALE CLAUSE
Products sold by The Smart Ritual are for personal use only and may not be resold or redistributed without prior written authorisation. Orders suspected of resale intent may be cancelled unilaterally, with a full refund.
26. ACCURACY OF CUSTOMER INFORMATION
The Customer agrees to provide accurate and complete information when placing an order. The Smart Ritual cannot be held responsible for delivery delays or errors due to incorrect information provided. Any additional costs resulting from such errors shall be borne by the Customer.
27. LIMITED WARRANTY AND USAGE RESTRICTIONS
Certain products may require specific usage or contain usage limitations. The Customer is responsible for following the instructions provided on the Site or in the product manual. Improper or non-compliant use voids any warranty.
28. ORDER TRACKING
The Smart Ritual provides order tracking via link or tracking number sent by email after dispatch. Tracking is managed by the carrier and may be subject to independent interruptions. Any issues should be reported promptly to customer service.
29. DELIVERY COUNTRIES
The Smart Ritual ships to selected countries listed in the FAQ section of the Site. Customers should verify eligibility before ordering. The company reserves the right to amend the list without prior notice.
30. CUSTOMER TESTIMONIALS AND REVIEWS
The Smart Ritual reserves the right to use customer reviews or testimonials received by any means (website, social media, email, etc.) for communication or promotional purposes. By submitting a review, the Customer agrees that it may be publicly shared without limitation or compensation. Customers may request modification or removal by contacting info@agape-paper.com.
